What Makes New York SNAP Eligibility Different From Other States
New York operates SNAP with several features that set it apart:
200% FPL BBCE — no asset test for most households. New York uses Broad-Based Categorical Eligibility (BBCE) at 200% of the federal poverty level with no asset limit for most households, making it among the most accessible SNAP states nationally.
NYC SNAP Centers vs. county DSS offices. New York is the only state with a dedicated network of SNAP Centers — specialized offices in New York City that handle only SNAP applications. Outside NYC, SNAP is administered by county Departments of Social Services (DSS) — 57 counties plus the five NYC boroughs. NYC has a separate SNAP phone line: (718) 557-1399. This means the application process in NYC differs significantly from the rest of the state.
Statewide ABAWD waiver. New York has historically maintained a statewide ABAWD waiver — work requirements are not currently enforced anywhere in the state. Contact OTDA to confirm current waiver status, as federal rule changes may affect this.
Farmers’ Market Nutrition Program. New York operates the Farmers’ Market Nutrition Program (FMNP), providing additional vouchers for seniors and WIC recipients to purchase fresh produce at participating farmers’ markets — separate from the standard EBT acceptance at markets.
ConnectEBT mobile app. New York’s EBT system supports the ConnectEBT mobile app (in addition to the myBenefits portal) for balance checks, transaction history, and card management.
New York SNAP is administered by the Office of Temporary and Disability Assistance (OTDA), reachable at (800) 342-3009, through local county DSS offices or NYC SNAP Centers.
Who Is Eligible for New York SNAP Benefits?
To qualify for SNAP in New York, your household must meet the following:
- Income: Gross income at or below 200% FPL (most households). Net income at or below 100% FPL after deductions.
- Residency: Must currently live in New York
- Citizenship: Must be a U.S. citizen or qualified legal resident. Lawful permanent residents with 5+ years in the US, refugees, asylees, and children under 18 may qualify.
- Work requirements: Currently waived statewide — contact OTDA to confirm current status
- Asset limits: No asset limit for most households under BBCE. Exception: elderly/disabled households exceeding the 200% FPL gross limit face a $4,500 asset cap.

What Counts as Income for New York SNAP?
Counted income includes:
- Wages and salaries (gross, before taxes; allowable business expenses deducted for self-employment)
- Social Security and SSI payments
- Unemployment insurance benefits
- Child support or alimony received
- Workers’ compensation
- Pensions and retirement withdrawals
Not counted: LIHEAP energy payments, EITC tax refunds, educational grants and loans used for tuition and fees, and certain veterans’ benefits. See the full list of income excluded from SNAP.
Asset Limits for New York SNAP
New York’s 200% BBCE removes the asset test for most households. Households receiving Temporary Assistance (TA) or SSI are categorically eligible and face no asset test.
Exception: Households with an elderly or disabled member that exceed the 200% FPL gross income limit must have countable assets below $4,500.
Countable assets: Cash, bank account balances, stocks, bonds, money market funds, and secondary properties (excluding primary residence).
Non-countable assets: Primary home, all retirement accounts (401k, IRA, pension), household goods, and all vehicles used for household transportation (no value limit).
New York SNAP Household Definition
A SNAP household includes everyone who lives together and buys and prepares food together — typically spouses and parents with children under 22 living at home.
You can qualify as a separate SNAP household if you buy and prepare food independently, unless you are a spouse or a parent with children under 22.
A senior with a disability unable to prepare food due to a permanent disability may form a separate household if the combined income of others they live with is below 165% FPL.
If household composition changes after approval, you are required to report those changes to SNAP within 10 days.
New York SNAP Work Requirements
New York has historically maintained a statewide ABAWD waiver — work requirements have not been enforced statewide. Contact OTDA at (800) 342-3009 or your local DSS office to confirm current waiver status, as federal rule changes may affect this.
For non-exempt recipients, New York administers work requirements through the SNAP Employment and Training (E&T) program.
For background on federal SNAP work rules, see our guide on SNAP work requirements.
Who Would Be Exempt from New York SNAP Work Requirements?
Even outside the statewide waiver, you would be exempt if you are:
- Under 18 or 65 and older
- Pregnant
- Responsible for a child under 18 or a dependent with a disability
- Physically or mentally unable to work
- Receiving SSI, Social Security disability, or other disability-related benefits
For the complete exemption list, see who is exempt from SNAP work requirements.
Deductions That Improve New York SNAP Eligibility
Deductions reduce your net income — the lower your net income, the higher your SNAP benefit:
| Deduction | Amount / Rule |
|---|---|
| Standard deduction | $204 (households of 1–3); $217 (household of 4); $251 (household of 5); $291 (households of 6+) |
| Earned income deduction | 20% of all gross wages automatically deducted |
| Dependent care costs | Actual costs required for work or school |
| Child support paid | Court-ordered payments to non-household members |
| Medical expenses | Unreimbursed costs over $35/month for elderly or disabled members (or a standard $136 deduction if verified) |
| Excess shelter costs | Rent + utilities above 50% of net income, capped at $744 (no cap for elderly/disabled) |
| Standard Utility Allowance | Fixed deduction for households paying heating or cooling separately |
| Homeless shelter deduction | $198.99/month — no documentation required |
New York insight: New York City has the highest rents in the United States — median one-bedroom apartments in Manhattan regularly exceed $3,500/month, with Brooklyn and Queens often exceeding $2,500. Even outer borough and upstate New York households face elevated rents and utility costs. The shelter deduction — which removes excess rent and utility costs from net income — is frequently the single most impactful factor determining SNAP eligibility and benefit amount for New York households. For elderly or disabled households, this deduction is completely uncapped.
New York SNAP Benefit Amounts for 2026
Your monthly benefit equals the maximum allotment minus 30% of your net income. Households with zero net income receive the full maximum:

| 3 | $768 |

Special Situations for New York SNAP Applicants
Seniors and Social Security Recipients
New York households with members age 60+ or receiving SSI are exempt from the gross income test entirely. Only net income applies, with no cap on the shelter deduction. Can seniors on Social Security get food stamps? — Yes, and New York City’s extremely high rents make the uncapped shelter deduction especially powerful for fixed-income seniors.
Veterans
New York has a large veteran population, particularly on Long Island and in the Hudson Valley. Veterans may qualify for SNAP based on income alone, with work requirement exemptions for service-connected conditions. See our guide on food stamps for veterans.
Unemployment Recipients
New York’s maximum weekly unemployment benefit ($504/week) is among the higher rates in the Northeast. Despite this, many laid-off New Yorkers qualify for SNAP during job transitions given the state’s extremely high housing costs. Learn about food stamps and unemployment.
WIC and SNAP Together
Pregnant women and households with children under 5 may qualify for both SNAP and WIC simultaneously. Check New York WIC income guidelines to see if you qualify for both programs.
Frequently Asked Questions About New York SNAP Eligibility
What is different about applying for SNAP in New York City?
New York City has a dedicated network of SNAP Centers — specialized offices in all five boroughs that handle only SNAP applications. NYC also has a separate SNAP phone line at (718) 557-1399. Outside NYC, SNAP is handled by your county Department of Social Services. Processing times and resources vary significantly between NYC and upstate counties.
Are work requirements enforced in New York?
Not currently. New York has historically maintained a statewide ABAWD waiver, meaning work requirements are generally not enforced anywhere in the state. Contact OTDA at (800) 342-3009 to confirm current waiver status, as federal rule changes may affect this going forward.
Does New York raise the SNAP income limit above the federal standard?
Yes. New York uses 200% BBCE — the maximum allowed under federal rules. The gross income limit for a household of 1 is $2,878/month, compared to $1,768 in states at the federal 130% FPL floor.
What is the Temporary Assistance (TA) program and how does it affect SNAP eligibility?
Temporary Assistance (TA) is New York’s version of TANF — cash assistance for low-income families. TA recipients are categorically eligible for SNAP, meaning they automatically qualify without separately passing the income or asset tests.
Can I receive both SNAP and Medicaid in New York?
Yes. New York expanded Medicaid beyond 138% FPL — New York is one of the most expansive Medicaid states in the country, with coverage for adults up to 138% FPL and higher thresholds for children, pregnant women, and seniors. Many New York SNAP households qualify for both simultaneously. Check New York Medicaid income limits to see if your household qualifies.
Where can I get emergency food assistance in New York?
In New York City, contact the Food Bank for New York City at (212) 894-8060. In upstate New York, contact Foodlink at (585) 328-3380. Statewide, call New York 2-1-1 for referrals to food pantries and meal programs across all 62 New York counties.
